Beyond Accountability: A Legal Report on the Policy of Impunity in the Context of Crimes Committed Against Palestinian Prisoners.
This report seeks to analyze the phenomenon of impunity in the context of crimes committed against Palestinian prisoners, with a particular focus on the absence of legal accountability for Israeli occupation authorities, especially in light of the complicity of the judicial system and internal oversight bodies.
The report further examines the obligations of the occupying power to prohibit torture by outlining the international conventions it has signed that prohibit torture. It also reviews decisions of the Supreme Court related to the torture of Palestinian prisoners, analyzes these findings, and links them to the legal and human rights realities experienced by prisoners inside Israeli detention facilities.
In addition, the report reviews the complaints mechanisms within the Israeli judicial system and assesses the effectiveness of this system in addressing such complaints in the absence of genuine justice, through the examination of a number of case studies that demonstrate the existence of a policy of impunity.
The report also highlights the role of the international community in confronting the policy of impunity, with particular emphasis on the role of the International Criminal Court in investigating crimes committed against prisoners and the possibility of holding Israeli officials accountable in accordance with international criminal law.
